What is ‘trespassing’, anyway? Most of us think we know. But the more you think about it, the more complex it can get. For example, could you be sued for trespassing on property that you are the owner of? Of course you could! If you rent it to someone else, you might have only a limited right to enter the property (for inspection or repairs, for example). If you enter the property for any other reason (or without proper notice) you might find yourself being told ‘Yew git off your property!’ The point is that the concept of trespassing protects possession, and not necessarily ownership.

Another unique point of trespassing law is that liability is absolute. If you take an umbrella from a restaurant when you leave believing it is yours (because it looks just like yours), you have not legally stolen anything even if the umbrella belongs to someone else, as long as you can established that you reasonably believed it was yours. On the other hand, if you build a shed on land that you believe is yours (because the map given to you by the local land office indicates that it is yours), you are a trespasser even though there’s no way you could have known that the land wasn’t yours (there are hidden complexities to this which are beyond the scope of this article). Note that the amount of damages might be less if your trespassing was unintentional. They may even be nominal (e.g. one dollar) if your trespassing did no harm. On the other hand, a ‘non-volitional intrusion’ is not trespass – if you tripped over a stone and fell into your neighbor’s yard, for instance.

You are also not trespassing if you have a legitimate invitation – and invitations can be implied rather than actual. That is why you can’t sue your mail carrier for walking across your yard to deliver your mail without permission.

Cars big winner as 34th Annual Annie Awards handed out

Cars drove home the big prize last night, from the 34th Annual Annie Awards. The animation industry’s highest honor, ASIFA-Hollywood’s Annies recognise contributions to animation, writing, directing, storyboarding, voice acting, composing, and much more.

As mentioned, Pixar took home the big prize last night, after facing stiff competition from four other Happy Feet, Monster House, Open Season, and Over the Hedge.

But the biggest winner of the night didn’t get a “Best Animated Feature” nod at all. Flushed Away won five feature animation categories including Animated Effects (Scott Cegielski), Character Animation (Gabe Hordos), Production Design (Pierre-Olivier Vincent), Voice Acting (Sir Ian McKellan as Toad), Writing (Dick Clement, Ian La Frenais, Chris Lloyd, Joe Keenan, and Will Davies).

Over The Hedge won awards for Directing (Tim Johnson and Karey Kirkpatrick), Storyboarding (Gary Graham), and Character Design (Nicolas Marlet).

Of little surprise, Randy Newman won an Annie for Cars in the “Music in an Animated Feature Production” category. Newman has won many Oscars for his movie music, and has a nomination this year for the song “Our Town”. Newman didn’t attend the Annies, instead picking up a Grammy for “Best Song Written For Motion Picture, Television Or Other Visual Media”.

DisneyToon Studios’ Bambi II won “Best Home Entertainment Production”, while “Best Animated Short Subject” went to Blue Sky Studios’ No Time For Nuts, which is based on Ice Age.

“Best Animated Video Game” went to Flushed Away The Game, while a United Airlines ad named “Dragon” won a “Best Animated Television Commercial” Annie for DUCK Studios.

U.S. presidential candidate Mark Everson challenges debate exclusion

U.S. Republican Party presidential candidate Mark Everson, former commissioner of the Internal Revenue Service (IRS), filed a complaint on Monday with the Federal Election Commission (FEC) to challenge his exclusion from Thursday’s first Fox News Republican Party presidential debate. Everson argues his exclusion violates Title 11 of the U.S. Code of Federal Regulations in that debate hosts must not “structure the debates to promote or advance one candidate over another”, and must “use pre-established objective criteria to determine which candidates may participate in a debate.”

Everson served as Commissioner of the IRS from 2003 to 2007, during the George W. Bush administration. After his departure, he briefly served as CEO of the American Red Cross, worked in the cabinet of Indiana governor Mitch Daniels, and worked for the tax consulting firm alliantgroup. He announced his candidacy this past March with a sixteen-page open letter in which he outlined the six pillars of his campaign: amnesty for illegal immigrants, reinstatement of the military draft, a promise to serve only a single presidential term, and calls for tax reform, deficit reduction, and corporate responsibility.

Fox News claims Everson fails to meet the criteria it established for Thursday’s two debates. Only seventeen candidates meet the criteria, which require a candidate “consistently” be included in “recognized” opinion polls. The prime-time event features the top ten candidates by average polling percentage. The other seven participate in a separate debate just before the prime time event.

In his complaint, Everson urges the FEC to compel Fox News to include him in the second tier debate as the eighth participant.

Everson argues Fox News, in violation of Title 11, “structure[d] the debates to promote or advance one candidate over another” through a July 27 change to its criteria that replaced a pre-existing one percent polling threshold with a threshold admitting those “consistently” included in “recognized” polls. He alleges this was done to ensure the inclusion of the low-polling candidates former Hewlett-Packard CEO Carly Fiorina, former New York governor George Pataki, Senator Lindsey Graham, and former Virginia governor Jim Gilmore, because Fox News recognizes these candidates as “major players.”

Furthermore, Everson argues the Fox News criteria are not “objective,” as Title 11 requires, because they fail to define the terms “consistently” and “recognized” when referring to polls. He asserts he was included in the Republican Party’s online straw poll in May and is the only candidate still listed on that poll who has been excluded from Thursday’s debate.

Election law expert Richard Winger, publisher of Ballot Access News, says Everson is “completely correct” in his challenge. However, he believes Everson only has a chance of success if he actually files a lawsuit rather than simply complaining to the FEC.

Installing heavy machinery into a manufacturing environment is a laborious and time consuming affair. Whether it is a large printing press, a generator, turbine, hydraulic press or some other massive heavy and unwieldy apparatus, fixing the door and installing the floor requires planning, patience and elbow grease. Whenever one needs to install heavy machinery of any type, it is best to first plan for every contingency and then double check all complications.

Once delivered and installed, it is necessary to do leveling first through machine leveling tools. Machine leveling is not as simple as one may think about. Axes that are on the floor should be loosely tied down and leveling points adjusted evenly to start out. Machine guards and covers need to be removed or put out of the way so that the sideways top surface is exposed where leveling to be checked. Machine leveling should not be checked on the table top, unless geometry between table top and way top surface is known. Normal wear to the table top and the possibility of worn sliding surfaces introduce the uncertainty that the table top may not be parallel to the way top causing a false level reading.

Therefore, only the way surface is used for leveling unless the condition of the table top to way top surface can be verified. If there is a saddle then saddle needs to be leveled first in both the directions and after that the table ways are leveled in both directions. Cross leveling done on a separate precision removes the roll of an axis. After the axes are adjusted the previous axis is rechecked to verify that no movement has occurred. Anchor points are also tightened evenly during the leveling process to maintain the straightness condition of the axis. After the main axis is leveled the secondary axis is leveled in the same manner as the main axis. Minor differences between machines tool dictate the exact process.

Thus, leveling is an important part of a machine tool installation process because it significantly influences the product quality, machine tool accuracy and machine lifetime. Conventional leveling procedures are performed by skilled engineers using machine leveling tools.

EU, US declare intent to cooperate on climate change at summit

A European Union-United States summit held in Slovenia produced a draft declaration outlining the groups’ future cooperation on climate change, energy security and financial stability. Yesterday was the final day of the summit, the last EU-US summit that US President George W. Bush will attend in his current role.

Hopes of a major breakthrough on the topic of climate change were low going into the summit. The foreign minister of Slovenia, Dimitrij Rupel, commented last week that, “on climate change, the positions are split.” Members of the 27-nation EU have regularly expressed their dissatisfaction with the US for not having ratified the Kyoto Protocol, an agreement with binding greenhouse gas emissions targets. Doubts about the summit’s efficacy were not misplaced, as no firm targets were set for actions on climate change.

The EU and US agreed to cooperate increasingly in science and technology research for energy and climate change purposes, including carbon capture and storage, and hydrogen fuel cells. The EU reaffirmed its commitments as per the Kyoto Protocol, but the US restated that developing countries such as China and India must be made to sign up to such global agreements before it will sign on.

Steps to secure energy sources for the future were also discussed. Promoting the creation of multiple pipelines to supply more natural gas to Europe was determined a priority, despite the fact that this would encourage an increase in emissions from gas use.

Bush commented in a follow-up news conference: “I think we can get a global agreement on climate change during my presidency – just so you know.”

Hot air balloon fire kills two, injures eleven in Canada

A hot air balloon caught fire and crashed in western Canada. Two people were killed and 11 were injured.

The disaster occurred as the airship was preparing to take off from Surrey, British Columbia, a suburb of Vancouver. An unknown source caused a fire in the basket of the tethered balloon, which then broke free and rose into the air.

Of the 12 passengers and one pilot on board at the time, 11 escaped the balloon with severe burns and other non-life-threatening injuries by jumping out in mid-air. The balloon then collapsed, crashing into a motorhome park with two people still trapped on board, who were killed in the subsequent fire. Four static caravans and two cars were also destroyed in the blaze.

The two deceased are believed to be a mother and daughter. Their family was on scene during the disaster and watched as the balloon burnt up and crashed.

Witness Don Randall, who photographed the accident, said the thing went up about 400 feet (122m) in the air at which point it melted enough of the balloon it collapsed.”The basket was basically a fireball. It just dropped like a stone. I’m just thinking, ‘Oh geez, I hope there’s nobody in that thing. It’s basically a burning death up there.”‘

Bill Yearwood, an investigator with the Transportation Safety Board of Canada, told reporters what preliminary information was available: “The crew loaded 12 passengers and was preparing to launch when a fire erupted. The pilot asked the passengers to get out of the basket. The balloon was tethered at the time, but then broke and came loose. The balloon climbed into the air before collapsing in a residential area in the park. They were all trying to get out. I can’t tell you what exactly happened when the balloon was loosened from the tether.”

Injured survivor Diana Rutledge questioned the pilot, Steve Pennock,’s actions after the fire broke out, pointing out that he was first off the balloon. “He was in perfect shape,” she said. “I thought, what is this all about? Wouldn’t he have stayed on to try to stop the fires?”

Joyce Genest, a resident at the park, also questioned procedure that day. “I stopped to watch the balloon get inflated,” she said. “Normally it takes 25 minutes and it’s quite gorgeous to watch. They are never in a big hurry. This time they took about ten minutes.” She said the passengers then got straight into the balloon, an unusual occurrence. “Normally the pilot gets in and tests the gun twice and then everybody gets in.” As soon as everybody was in, he hit the gun and the flame went sideways.”

An interview with gossip columnist Michael Musto on the art of celebrity journalism

There are two things one can expect on a trip to see Michael Musto at the offices of the Village Voice: a 20-minute round-trip wait for the elevator and rapid fire answers from one of the most recognizable gossip columnists in the United States. Musto, in addition to his appearances on Countdown with Keith Olbermann and the E! network, has been writing his column for the Voice since 1984. He has recently compiled the best of them in a book released this year titled, La Dolce Musto: Writings by the World’s Most Outrageous Columnist. He was Carrie Bradshaw, replete with a prodigious use of puns, before Sex in the City was a thought. His column is a romp through his life, spats and opinions on socio-political issues. As David Thigpen of the Chicago Tribune wrote, Musto is “a funny and caustic satirist who masquerades as a gossip and nightlife columnist.”

Musto, a Columbia University graduate, is a rarity in today’s celebrity world: he is accessible. He often corresponds with his readers and his public functions are a mix of parties, nightclubs, academic lectures, university panels and film premieres.

He is friendly and frank, and he welcomes people to join him in his world (“I just got a message that Michael Lucas died!” he says staring wide-eyed at his phone; the message turned out to be false). IBM to launch software that works on Linux, Windows and Macintosh

On Sunday the representatives of International Business Machines Inc. said that the company will launch its new desktop software system for businesses. IBM’s new product is called “Open Client Offering”. The company hopes that its product will put Macintosh or Linux software on a more equal footing with Windows.

The Open Client Offering software was developed by IBM in-house, as well as with partners like Novell Inc. and Red Hat Inc. It is to answer the questions regarding the cost-effectiveness of managing Linux or Apple desktop personal computers alongside Windows PCs.

IBM officials stated that Open Client Offering will allow enterprises to use the same software on Windows, Linux or Apple’s OS X. It will be unnecessary for companies using Open Client to pay Microsoft for licenses for operations because these will no longer rely on Windows-based software.

Scott Handy, IBM’s vice president of Linux and open source, stated that the company worked together with the open source community and in the end found a way to develop a software that is able to function regardless of the operating system.

To create an alternative to Microsoft, IBM is going to offer Open Document Format software that the company developed for word processing, spreadsheets or presentations, instant messaging and blog tools and Internet Explorer’s long time rival – Firefox Web browser.

The software developers at IBM believe that the usage of Open Client Offering can cut the cost of managing applications as well as maintenance and cost regarding customer support on company networks that require other software rather than Windows.

PSA Peugeot Citroen, being the second largest car manufacturer, signed a multi-year agreement with Novell, which is the provider of Linux software, to run Linux on its 20,000 desktop PCs. In addition Linux will be installed on 2,500 server computers.

RedMonk’s analyst, Stephen O’Grady, said that today there is a strong appetite for Windows alternatives. However, he said, this doesn’t mean that the alternatives are to displace Windows wholesales. O’Grady outlined that no one is going to significantly damage the desktop dominance of Microsoft.
